Welcome to the ACTIVATE Portal ("Portal"), operated by ACTIVATE ("we," "us," or "our"). By accessing or using the Portal, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Portal.
1. Eligibility
The Portal is intended for use by adults (18 years of age or older) who are participating in or affiliated with the ACTIVATE real estate coaching program through Keller Williams. By using the Portal, you represent that you meet this eligibility requirement.
2. Account Registration & Access
Access to the Portal is by invitation only. You may receive access via a magic link or sign-up invitation from an ACTIVATE coach or administrator. You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate your account at any time, with or without cause, including if your membership status is changed to inactive.
3. Acceptable Use
You agree to use the Portal only for its intended purposes in connection with the ACTIVATE program. You may not:
- Share your account credentials with any other person
- Attempt to access another user's account or data
- Use the Portal to transmit harmful, offensive, defamatory, or unlawful content
- Reverse engineer, scrape, or attempt to extract the source code of the Portal
- Use any AI tools provided through the Portal for purposes unrelated to your real estate business
- Circumvent or attempt to circumvent any access controls or security measures
- Use the Portal in any manner that could damage, disable, or impair the service
4. Community Guidelines
The Portal includes a community feed feature. When posting, commenting, or interacting in the community, you agree to:
- Be respectful and professional in all interactions
- Not post content that is discriminatory, harassing, or threatening
- Not share confidential client information or proprietary business data of others
- Not use the community for solicitation or advertising unrelated to ACTIVATE
Coaches and administrators have moderator privileges and may edit, remove, or pin content at their discretion.
5. AI-Powered Tools
The Portal provides access to AI-powered tools including script practice, content generation, listing descriptions, newsletters, and a forms reference chatbot. By using these tools, you acknowledge that:
- AI-generated content is provided for informational and productivity purposes only
- AI outputs do not constitute legal, financial, or professional advice
- You are solely responsible for reviewing and verifying any AI-generated content before using it in your business
- AI tool usage is subject to daily rate limits
- We may log usage data (prompts and token counts) for quality, cost management, and abuse prevention
The "Bob the Broker" forms reference tool provides general information about real estate forms. It is not a substitute for legal advice. Questions involving legal interpretation will be escalated to your designated broker.
6. User Content
You retain ownership of content you submit to the Portal, including community posts, comments, images, activity data, and pipeline information. By submitting content, you grant ACTIVATE a non-exclusive, royalty-free license to use, display, and store that content as necessary to operate the Portal and the ACTIVATE program.
You are solely responsible for any content you submit and represent that you have all necessary rights to share such content.
7. Intellectual Property
The Portal, including its design, software, scripts library, playbooks, AI tool prompts, and all associated content, is the property of ACTIVATE and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Portal without our prior written consent.
Marketing materials you generate using the Portal's tools (presentations, flyers, social posts, etc.) are yours to use in your real estate business.
8. Third-Party Services
The Portal integrates with third-party services to function, including cloud hosting, authentication, database, email delivery, AI processing, and error monitoring services. Your use of the Portal is also subject to the terms and policies of these third-party providers. We are not responsible for the practices of these third parties.
9. Disclaimers
THE PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PORTAL WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. YOUR USE OF THE PORTAL IS AT YOUR OWN RISK.
ACTIVATE does not guarantee any particular business results, production outcomes, or income from participation in the ACTIVATE program or use of the Portal.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ACTIVATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PORTAL, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF BUSINESS, OR LOSS OF PROFITS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11. Account Deactivation
If your account is deactivated (by a coach or administrator), your access to the Portal will be restricted. Your data will be retained in our systems for program reporting and record-keeping purposes. You may request deletion of your personal data by contacting us.
12. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Portal (via an announcement or notification). Your continued use of the Portal after such changes constitutes acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to conflict of law principles.
